ACCEPTABLE USE POLICY

1. Introduction

This Acceptable Use Policy (“Policy”) outlines the prohibited uses of the Watobu platform, website, and services (collectively, the “Service”). This Policy is an integral part of the Watobu Terms of Service.

By accessing Watobu, you agree to use the Service only for lawful purposes and in accordance with this Policy. Violation of this Policy may result in the immediate suspension or permanent termination of your account without notice or refund.

2. Prohibited Actions: System & Security

To protect our infrastructure and the experience of other users, you strictly agree NOT to:

  • Probe or Scan: Attempt to probe, scan, or test the vulnerability of our systems, networks, or authentication measures (Auth0) without express written authorization from Watobu.
  • Reverse Engineering: Reverse engineer, decompile, disassemble, or decipher any hardware, software, or algorithms used to provide the Service.
  • Interference: Interfere with or disrupt the access of any user, host, or network, including sending viruses, overloading, flooding, spamming, or mail-bombing the Service.
  • Bypass Restrictions: Attempt to bypass any rate-limiting, geo-blocking, or access control measures we have implemented (violation of this clause may constitute a violation of the DMCA Anti-Circumvention Provisions).

3. Data Collection & Scraping (Zero Tolerance)

Watobu invests significant resources into manually curating and tagging workflows. Therefore:

  • No Automation: You may not use bots, spiders, crawlers, scripts, or any other automated means to access, copy, or index the Service.
  • No “Headless” Browsers: The use of tools like Puppeteer, Selenium, or Playwright to navigate the Service is prohibited.
  • No AI Training: You may not use data from Watobu to train, fine-tune, or test Artificial Intelligence, Machine Learning models, or Large Language Models (LLMs).

4. Excessive Usage & Manual Abuse

Even if done manually by a human, “abusive consumption” of our content undermines the Service. We reserve the right to throttle, suspend, or ban accounts that exhibit:

  • Bulk Downloading: Systematically opening, saving, or downloading a volume of images or workflows that exceeds what a human could reasonably review for genuine research purposes in a single session.
  • Rapid Request Patterns: Generating traffic patterns that place an undue burden on our AWS infrastructure, regardless of whether the traffic is automated or manual.

5. Competitor Restrictions

Definition: For the purposes of this Policy, a “Competitor” is defined as any entity, individual, or organization that operates, develops, or contributes to a feature research library, UI/UX pattern database, screenshot archive, or similar design reference tool.

Permitted vs. Prohibited Use:

  • Permitted: Competitors may access the Service for the sole purpose of personal market research or benchmarking, provided such access does not violate any other section of this Policy.
  • Strictly Prohibited: Competitors are strictly prohibited from using the Service to:
    1. Copy, scrape, or reproduce our database structure, tagging taxonomy, or screenshots to populate a competing product.
    2. Reverse-engineer our curation logic to improve a competing algorithm or service.
    3. Systematically extract data to build a “derivative work” that competes with Watobu.

Breach: Any use of the Service by a Competitor to misappropriate data for commercial advantage is considered a material breach of this Policy and misappropriation of trade secrets.

6. Account Integrity

  • No Sharing: You may not share your login credentials. A “Pro” account is for one specific individual. Sharing passwords to split the cost or grant access to a team is a material breach of this Policy.
  • No Transfer: You may not sell, trade, or otherwise transfer your account to another party.

7. Enforcement and Legal Status

Watobu reserves the right to investigate any violation of this Policy. If we determine that you have violated this Policy, we may take action including:

  • Immediate Suspension: Temporary or permanent removal of access.
  • Federal Legal Action: Unauthorized access to our servers or data scraping in violation of this Policy may be deemed a violation of the Computer Fraud and Abuse Act (CFAA) (18 U.S.C. ยง 1030) and may subject you to federal civil and criminal penalties.
  • Liquidated Damages: As outlined in our Terms of Service, we may pursue financial damages for scraping or data theft.
